Article R5124-67 of the French Public Health Code

Where advertising in favour of a pharmaceutical company or establishment mentions a medicinal product, it is governed by the provisions of sections 1, 2 and 3 of Chapter II of this Title; where it mentions a product or object listed in section 4 of the same chapter, it is governed by the provisions of that section.

The provisions of the previous paragraph do not apply to scientific, technical or financial information documents issued by the establishment or company which are not intended to promote a medicinal product.

Lorsqu’une publicité en faveur d’une entreprise ou d’un établissement pharmaceutique mentionne un médicament, elle est régie par les dispositions des sections 1, 2 et 3 du chapitre II du présent titre ; lorsqu’elle mentionne un produit ou objet figurant à la section 4 du même chapitre, elle est régie par les dispositions de cette section.

Les dispositions de l’alinéa précédent ne sont pas applicables aux documents d’information à caractère scientifique, technique ou financier, émis par l’établissement ou l’entreprise, qui n’ont pas pour objet la promotion d’un médicament.
