Article R5125-11 of the French Public Health Code

Any change to the conditions under which the pharmacy is set up, relating to the surface area of the premises, the addition or removal of a storage room within the meaning of article R. 5125-8, alterations to the building, or related to the implementation of a new activity, must be declared in advance to the general director of the regional health agency and to the competent council of the national order of pharmacists.

The opening of an annex to a pharmacy located in an airport, as provided for in article L. 5125-7-1, is subject to the provisions of the previous paragraph.

Any relocation of the pharmacy without a change of address, including temporary relocation due to works within the pharmacy, is subject to the declaration provided for in the first paragraph.

Any change in the address of the pharmacy without relocation is notified to the Director General of the Regional Health Agency and to the competent council of the National Order of Pharmacists. The Director General of the Regional Health Agency will take account of this change in an order amending the dispensary’s licence. He communicates this information to the regional representative appointed by each trade union representing the profession within the meaning ofarticle L. 162-33 of the Social Security Code.

Toute modification des conditions d’installation de l’officine relative à la surface des locaux, à l’ajout ou la suppression d’un local de stockage au sens de l’article R. 5125-8, aux aménagements du bâti, ou liée à la réalisation d’une nouvelle activité, est préalablement déclarée au directeur général de l’agence régionale de santé et au conseil compétent de l’ordre national des pharmaciens.

L’ouverture de l’annexe d’une officine implantée dans un aéroport prévue à l’article L. 5125-7-1 est soumise aux dispositions de l’alinéa précédent.

Tout déplacement de l’officine sans changement d’adresse, y compris en cas de déplacement provisoire pour cause de travaux au sein de l’officine, fait l’objet de la déclaration prévue au premier alinéa.

Toute modification de l’adresse de l’officine sans déplacement est portée à la connaissance du directeur général de l’agence régionale de santé et du conseil compétent de l’ordre national des pharmaciens. Le directeur général de l’agence régionale de santé prend en compte cette modification dans un arrêté modificatif de la licence de l’officine. Il communique cette information au représentant régional désigné par chaque syndicat représentatif de la profession au sens de l’article L. 162-33 du code de la sécurité sociale.
