The legal representative of the company shall notify the president of the competent council of the Ordre des pharmaciens, by any means that provides proof of its date of receipt and within one month of the date on which it occurs, of any change in the situation declared in application of article R. 4222-3, enclosing supporting documents.
Subject to II of article 5 of law no. 90-1258 of 31 December 1990 relating to the practice in the form of companies of liberal professions subject to a legislative or regulatory status or whose title is protected, if the liberal practice company ceases to comply with the legislative and regulatory provisions in force, the president of the competent council of the ordre gives it formal notice to regularise its situation within a period that he sets. If it fails to do so, the council of the professional body will order the company to be struck off the register by a reasoned decision notified to it by any means capable of proving the date of receipt.
A decision to deregister may only be taken after the partners or their representative have been given the opportunity to present their observations.
The decision to deregister may be appealed to the Conseil national de l’ordre, within the time limit set out in article L. 4222-5.
