Article R5125-5 of the French Public Health Code

The initial application may be confirmed until the expiry of a period of two months from notification of the rejection decision or from the formation of this decision when it is implicit.

In the meantime, the benefit of the rules of anteriority provided for in article L. 5125-20, attached to the initial application, is retained. For the purposes of grandfathering, the confirmatory application is considered to have been submitted on the date of the initial application.

The confirmatory application is submitted by the same person, for the same pharmacists and in respect of the same municipality and, where applicable, the same geographical area. It is accompanied by any updated or additional supporting documents that may be required. The Director General of the Regional Health Agency registers the application and issues a receipt. It is examined under the conditions set out in articles R. 5125-2 to R. 5125-4.

Article R5125-5

La demande initiale peut être confirmée jusqu’à l’expiration d’un délai de deux mois à compter de la notification de la décision de rejet ou de la formation de cette décision quand elle est implicite.

Dans l’intervalle, le bénéfice des règles d’antériorité prévues à l’article L. 5125-20, attaché à la demande initiale est conservé. Pour l’application du droit d’antériorité, la demande confirmative est considérée comme présentée à la date de la demande initiale.

La demande confirmative est présentée par la même personne, pour les mêmes pharmaciens et au titre de la même commune et le cas échéant de la même zone géographique. Elle est accompagnée des pièces justificatives actualisées ou complémentaires éventuellement nécessaires. Le directeur général de l’agence régionale de santé enregistre la demande et en délivre récépissé. Elle est examinée dans les conditions prévues aux articles R. 5125-2 à R. 5125-4.
