Authorisation for the creation or transfer is granted by the Director General of the regional health agency with territorial jurisdiction after obtaining the opinion of the competent central council of the national order of pharmacists. The competent council is notified by any means that provides a date certain for receipt of the notification. If the national order of pharmacists has not given its opinion within three months of the date of receipt of the referral, the Director General of the regional health agency may take a decision.
A copy of the decision to authorise or the reasoned decision to refuse is sent to the Prefect of the department.
The authorisation shall specify:
1° The location or locations of the pharmacy’s premises;
2° The various locations of the establishments, services or organisations served by the pharmacy;
3° The tasks and activities carried out by the in-house pharmacy on its own behalf or on behalf of another in-house pharmacy and, where applicable, the pharmaceutical form, nature of the products or operations in the case of the activity provided for in 2° of I of article R. 5126-9;
4° The tasks or activities carried out by another in-house-use pharmacy on behalf of the in-house-use pharmacy;
5° The time spent by the managing pharmacist, expressed in weekly half-days.
