After checking the integrity of the seals, the two experts are given the sample previously held by the owner or holder and the sample previously held by the agent who took the sample and forwarded to the public prosecutor.
The examining magistrate will provide the experts with the sampling reports as well as the laboratory report, medical prescriptions, invoices, consignment notes, accounting documents and, in general, all documents that the person in question has deemed useful to produce or that the magistrate has had delivered to him. The judge will also order them to examine any comparative samples that may have been taken administratively or that may subsequently be taken on the judge’s orders.
No official method is imposed on the experts; they operate as they see fit, together or separately, each of them being free to use the procedures they consider most appropriate. However, they discuss their conclusions together and draw up a single report. If they are of different opinions, or if they have reservations about common conclusions, each of them shall state his opinion or reservations and the reasons for them. This report is filed within the time limit set by the judge.
