Article R5127-24 of the French Public Health Code

If the owner or keeper does not submit his sample intact within the time limit set by the examining magistrate, the sample is no longer taken into account. In this case, the two experts are assigned to examine a single sample. When, in the course of or as a result of their investigations, the experts are led to presume that a substitution of samples has been made, they are obliged to inform the investigating judge immediately and to make available to the judge any exhibits likely to reveal the substitution.

Si le propriétaire ou détenteur ne représente pas son échantillon intact dans le délai fixé par le juge d’instruction, il n’est plus fait état de cet échantillon. Les deux experts sont, dans ce cas, commis à l’examen d’un échantillon unique. Lorsque, au cours ou à la suite de leurs recherches, les experts sont conduits à présumer qu’une substitution d’échantillons a été opérée, ils sont tenus d’en informer aussitôt le juge d’instruction et de tenir à sa disposition les pièces à conviction susceptibles de révéler la substitution.
