Article R5131-7 of the French Public Health Code

For the purposes of this section, :

“Misuse” means use which does not comply with the intended purpose of the product, its normal or reasonably foreseeable use or its instructions for use, or with the special precautions for use referred to in point d of paragraph 1 of Article 19 of Regulation (EC) No 1223/2009 of 30 November 2009.

“Adverse reaction” means a reaction which is harmful to human health attributable to the normal or reasonably foreseeable use of a cosmetic product, in accordance with Article 2(1) o of the same Regulation.

“Serious undesirable effect” means an undesirable effect resulting in temporary or permanent functional incapacity, disability, hospitalisation, congenital anomalies, immediate life-threatening risk or death, in accordance with Article 2(1)(p) of the Regulation.

Pour l’application de la présente section, on entend par :

“Mésusage” : une utilisation non conforme à la destination du produit, à son usage normal ou raisonnablement prévisible ou à son mode d’emploi, ou aux précautions particulières d’emploi mentionnées au point d du paragraphe 1 de l’article 19 du règlement (CE) n° 1223/2009 du 30 novembre 2009.

“Effet indésirable” : une réaction nocive pour la santé humaine imputable à l’utilisation normale ou raisonnablement prévisible d’un produit cosmétique, conformément au o du paragraphe 1 de l’article 2 du même règlement.

“Effet indésirable grave” : effet indésirable entraînant une incapacité fonctionnelle temporaire ou permanente, un handicap, une hospitalisation, des anomalies congénitales, un risque vital immédiat ou un décès, conformément au p du paragraphe 1 de l’article 2 du même règlement.
