Without prejudice to the provisions of article R. 4235-61, when the prescription includes the information provided for in article R. 5132-3-1, pharmacists may only refuse to dispense medicinal products from lists I and II, with the exception of medicinal products subject to drug regulation pursuant to article R. 5132-39, prescribed in another Member State of the European Union by a health professional legally authorised or entitled to prescribe medicinal products in that State, only if it appears to them that the interests of the patient’s health require it or if they have legitimate and justified doubts as to the authenticity, content or intelligibility of the prescription, or the quality of the health professional who drew it up.
Without prejudice to the provisions of article R. 4235-61, pharmacists may not dispense medicinal products classified as narcotics and medicinal products included in lists I and II and subject to narcotics regulations pursuant to article R. 5132-39, prescribed in another Member State of the European Union by a health professional legally authorised or entitled to prescribe medicinal products in that State, only if the prescription includes the information provided for in article R. 5132-3-1 and complies with the provisions of article R. 5132-5 and sub-section 3 of this section when they are applicable.
By way of derogation from the provisions of the previous paragraph, pharmacists may dispense such medicinal products when the prescription does not comply with the provisions of article R. 5132-5 and sub-section 3 of this section which are applicable to them, up to the minimum quantity necessary to ensure continuity of treatment and to enable the patient to obtain a prescription which complies with these conditions.
