Article R5138-2-1 of the French Public Health Code

The declaration provided for in Article L. 5138-1 is sent to the Agence nationale de sécurité du médicament et des produits de santé by a person authorised to bind the company to which the establishment belongs, by any means enabling receipt to be acknowledged. It includes the following information:

1° The name or corporate name and address of the company to which the establishment belongs and the address of the establishment which carries out the activity of manufacturing, importing or distributing excipients;

2° The name and position of the declarant;

3° The nature of the activity or activities subject to declaration carried out by the establishment.

For manufacturers mentioned in 1° of Article R. 5124-2 and 1° of Article R. 5142-1 who import excipients for their own use, the mention of this activity in the statement provided for in Article R. 5124-46 or Article R. 5142-42 is equivalent to an import declaration.

Any change in the information contained in the declaration gives rise to a new declaration, communicated immediately to the Agency by any means capable of acknowledging receipt.

The cessation of activity of the establishment must be notified immediately, in the same way.

Article R5138-2-1

La déclaration prévue à l’article L. 5138-1 est adressée à l’Agence nationale de sécurité du médicament et des produits de santé par une personne habilitée à engager l’entreprise à laquelle appartient l’établissement par tout moyen permettant d’en accuser réception. Elle comprend les renseignements suivants :

1° Le nom ou la dénomination sociale et l’adresse de l’entreprise à laquelle appartient l’établissement ainsi que l’adresse de l’établissement qui exerce l’activité de fabrication, d’importation ou de distribution d’excipients ;

2° Le nom et la fonction du déclarant ;

3° La nature de la ou des activités soumises à déclaration exercées par l’établissement.

Pour les fabricants mentionnés au 1° de l’article R. 5124-2 et au 1° de l’article R. 5142-1 qui importent des excipients pour leur propre usage, la mention de cette activité dans l’état prévu à l’article R. 5124-46 ou à l’article R. 5142-42 vaut déclaration au titre de l’importation.

Toute modification des renseignements contenus dans la déclaration donne lieu à une nouvelle déclaration, communiquée immédiatement à l’agence par tout moyen permettant d’en accuser réception.

La cessation d’activité de l’établissement doit être communiquée immédiatement, dans les mêmes formes.
