Article R5141-47-5 of the French Public Health Code

In the event of agreement within the coordination group, referred to by the Director General of the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail or by another State :

1° In the case provided for in Article R. 5141-47-2, the Director General of the Agency notifies the States concerned and the holder of the agreement. In accordance with the assessment report thus approved, he will amend or withdraw, as appropriate, the marketing authorisation within thirty days of this notification;

2° In the case provided for in 1° of Article R. 5141-47-4, the Director General of the Agency will notify the States concerned and the applicant of the agreement. In accordance with the approved assessment report, he grants or refuses marketing authorisation within thirty days of this notification;

3° In the cases provided for in Article R. 5141-47-3 and 2° of Article R. 5141-47-4, the Director General of the Agency will grant or refuse the marketing authorisation in accordance with the assessment report thus approved within thirty days of notification of the agreement by the reference State.

Article R5141-47-5

En cas d’accord au sein du groupe de coordination, saisi par le directeur général de l’Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail ou par un autre Etat :

1° Dans le cas prévu à l’article R. 5141-47-2, le directeur général de l’agence notifie l’accord aux Etats concernés et au titulaire. Conformément au rapport d’évaluation ainsi approuvé, il modifie ou retire, le cas échéant, l’autorisation de mise sur le marché dans un délai de trente jours suivant cette notification ;

2° Dans le cas prévu au 1° de l’article R. 5141-47-4, le directeur général de l’agence notifie l’accord aux Etats concernés et au demandeur. Conformément au rapport d’évaluation ainsi approuvé, il délivre ou refuse l’autorisation de mise sur le marché dans un délai de trente jours suivant cette notification ;

3° Dans les cas prévus à l’article R. 5141-47-3 et au 2° de l’article R. 5141-47-4, le directeur général de l’agence délivre ou refuse l’autorisation de mise sur le marché en conformité avec le rapport d’évaluation ainsi approuvé dans un délai de trente jours à compter de la notification de l’accord par l’Etat de référence.
