Article R5145-8 of the French Public Health Code

The penalty decision may, where appropriate, be accompanied by a daily penalty payment.

This penalty payment is notified in accordance with the same procedural rules as the main sanction.

The amount of the daily penalty is calculated from the date of notification of the financial penalty until the date of fulfilment of the commitments required to put an end to the disputed situation, as determined by the Director General of the Agency, who may carry out a new inspection.

A periodic penalty payment may not be imposed on the first prosecution of an undertaking under the procedure provided for in this section.

Article R5145-8

La décision de sanction peut, le cas échéant, être assortie d’une astreinte journalière.

Cette astreinte est notifiée selon les mêmes règles de procédure que la sanction prononcée à titre principal.

Le montant de cette astreinte est calculé à compter du jour de la notification de la sanction financière jusqu’au jour de la réalisation des engagements mettant fin à la situation litigieuse constatée par le directeur général de l’agence en diligentant, le cas échéant, une nouvelle inspection.

Le prononcé d’une astreinte ne peut intervenir lors de la première poursuite d’une entreprise relevant de la procédure prévue par la présente section.
