Article R5146-1-3 of the French Public Health Code

The agents authorised by the Director General of the agency to perform the duties of inspector shall take the following oath before the judicial court within whose jurisdiction the head office of the agency is located: “I swear and promise to perform my duties well and faithfully and to observe in everything the duties imposed upon me. I also swear not to reveal or use anything brought to my knowledge in the performance of my duties. ”

The provisions of the previous paragraph do not apply to the public health inspecting pharmacists and veterinarians mentioned in article R. 206-1 and in 2° of the I of article R. 231-3-7 of the rural and maritime fishing code working as inspectors for the agency when they have already sworn an oath respectively as inspectors of the pharmacy mentioned in article L. 5127-1 or under the conditions of article R. 205-1 of the rural and maritime fishing code.

Les agents habilités par le directeur général de l’agence à exercer les fonctions d’inspecteur prêtent, devant le tribunal judiciaire dans le ressort duquel se trouve le siège de l’agence, le serment suivant : ” Je jure et promets de bien et loyalement remplir mes fonctions et d’observer en tout les devoirs qu’elles m’imposent. Je jure également de ne rien révéler ou utiliser de ce qui sera porté à ma connaissance à l’occasion de l’exercice de mes fonctions. ”

Les dispositions de l’alinéa précédent ne sont pas applicables aux pharmaciens inspecteurs de santé publique et aux vétérinaires mentionnés à l’article R. 206-1 et au 2° du I de l’article R. 231-3-7 du code rural et de la pêche maritime exerçant en qualité d’inspecteur de l’agence lorsqu’ils ont déjà prêté serment respectivement au titre de l’inspection de la pharmacie mentionnée à l’article L. 5127-1 ou dans les conditions de l’article R. 205-1 du code rural et de la pêche maritime.
