Article R519-21 of the French Monetary and Financial Code

Where the agreement relates to a credit transaction, the intermediary in banking and payment services shall enquire of the customer, including the potential customer, about his knowledge and experience of banking transactions as well as his financial situation and needs, so as to be able to offer him services, contracts or transactions suited to his situation.

The intermediary must also obtain from the customer, including the potential customer, information relating to the customer’s resources and expenses and any outstanding loans that the customer has taken out, enabling the credit institution or finance company to check the customer’s solvency.

Lorsque le contrat porte sur une opération de crédit, l’intermédiaire en opérations de banque et en services de paiement s’enquiert auprès du client, y compris du client potentiel, de ses connaissances et de son expérience en matière d’opérations de banque ainsi que de sa situation financière et de ses besoins, de manière à pouvoir lui offrir des services, contrats ou opérations adaptés à sa situation.

L’intermédiaire doit recueillir également auprès du client, y compris du client potentiel, des informations relatives à ses ressources et à ses charges ainsi qu’aux prêts en cours qu’il a contractés, permettant à l’établissement de crédit ou à la société de financement de vérifier sa solvabilité.
