Article R5211-19 of the French General Code of Local Authorities

In each of the departmental commissions for inter-communal cooperation provided for in article L. 5211-42 the number of members is set at 40.

This number is increased by one additional seat:

a) From a threshold of 600,000 inhabitants in the department, then per tranche of 300,000 inhabitants;

b) Per commune with more than 100,000 inhabitants in the department;

c) From a threshold of 400 communes in the department, then per tranche of 100 communes;

d) Per public inter-municipal cooperation body with its own tax status with more than 50,000 inhabitants in the department;

e) From a threshold of twenty-five public inter-municipal cooperation bodies with their own tax status in the department, then per tranche of ten bodies.

A prefectoral decree establishes in each department the total number of members of the commission as well as the number of seats allocated to each category of territorial authority or public establishment by applying the distribution rules set out in article L. 5211-43, rounded to the nearest whole number if necessary.

Dans chacune des commissions départementales de la coopération intercommunale prévues par l’article L. 5211-42 le nombre des membres est fixé à 40.

Ce nombre est augmenté d’un siège supplémentaire :

a) A partir d’un seuil de 600 000 habitants dans le département, puis par tranche de 300 000 habitants ;

b) Par commune de plus de 100 000 habitants dans le département ;

c) A partir d’un seuil de 400 communes dans le département, puis par tranche de 100 communes ;

d) Par établissement public de coopération intercommunale à fiscalité propre de plus de 50 000 habitants dans le département ;

e) A partir d’un seuil de vingt-cinq établissements publics de coopération intercommunale à fiscalité propre dans le département, puis par tranche de dix établissements.

Un arrêté préfectoral constate dans chaque département le nombre total de membres de la commission ainsi que le nombre de sièges attribués à chaque catégorie de collectivité territoriale ou d’établissement public par l’application des règles de répartition fixées à l’article L. 5211-43, éventuellement arrondi au nombre entier le plus proche.
