Article R5211-21 of the French General Code of Local Authorities

The representation of municipalities and public establishments for inter-municipal cooperation located in mountain areas provided for in article L. 5211-44-1 is ensured according to the following procedures:

1° For the application of 1° of Article L. 5211-43, a number of seats corresponding to the proportion of the number of these communes in each electoral college in relation to all the communes in this college shall be allocated to the communes located, in whole or in part, in these zones. This number is rounded to the nearest whole number. If, by application of the above, this number is zero, one seat is allocated to them;

2° For the application of 2° of Article L. 5211-43, a number of seats corresponding to the proportion of the number of these establishments in relation to all the public establishments of inter-municipal cooperation with their own tax status located, in whole or in part, in these zones, is allocated to the public establishments of inter-municipal cooperation with their own tax status in this college. This number is rounded to the nearest whole number. If, by application of the above, this number is zero, one seat is allocated to them;

3° For the application of 3° of Article L. 5211-43, a number of seats corresponding to the proportion of the number of these unions in relation to all the intercommunal unions in this college is allocated to the intercommunal unions located, in whole or in part, in these zones. This number is rounded to the nearest whole number. If, by application of the above, this number is zero, they are allocated one seat.

La représentation des communes et des établissements publics de coopération intercommunale situés dans les zones de montagne prévue par l’article L. 5211-44-1 est assurée selon les modalités suivantes :

1° Pour l’application du 1° de l’article L. 5211-43, il est attribué aux communes situées, en tout ou partie, dans ces zones, un nombre de sièges correspondant à la proportion du nombre de ces communes dans chaque collège électoral par rapport à l’ensemble des communes de ce collège. Ce nombre est arrondi à l’entier le plus proche. Si, par application de ce qui précède, ce nombre est nul, un siège leur est attribué ;

2° Pour l’application du 2° de l’article L. 5211-43, il est attribué aux établissements publics de coopération intercommunale à fiscalité propre situés, en tout ou partie, dans ces zones un nombre de sièges correspondant à la proportion du nombre de ces établissements par rapport à l’ensemble des établissements publics de coopération intercommunale à fiscalité propre dans ce collège. Ce nombre est arrondi à l’entier le plus proche. Si, par application de ce qui précède, ce nombre est nul, un siège leur est attribué ;

3° Pour l’application du 3° de l’article L. 5211-43, il est attribué aux syndicats intercommunaux situés, en tout ou partie, dans ces zones un nombre de sièges correspondant à la proportion du nombre de ces syndicats par rapport à l’ensemble des syndicats intercommunaux dans ce collège. Ce nombre est arrondi à l’entier le plus proche. Si, par application de ce qui précède, ce nombre est nul, un siège leur est attribué.
