Article R5211-9 of the French General Code of Local Authorities

When the decree or order dissolving a public inter-municipal cooperation establishment provides, under the conditions set out in the second paragraph of article L. 5211-26, the appointment of a liquidator, this is decided by the representative of the State in the department where the establishment has its registered office.

To this end, the representative of the State may appoint any person offering sufficient guarantees of good character, having the experience and competence in legal and financial matters deemed necessary for the accomplishment of his/her mission and having no interest in the operation. The liquidator carries out his mission on a voluntary basis.

The following may not be appointed as liquidators:

– members of the deliberative body or the staff of the public establishment of inter-municipal cooperation and its member communes;

– accountants and persons involved in budgetary and legality control of the public establishment of inter-municipal cooperation and its member communes;

– magistrates of the administrative and financial jurisdictions within whose jurisdiction the public establishment of inter-municipal cooperation has its registered office.

– members of the staff of the public establishment of inter-municipal cooperation and its member communes;

– members of the staff of the public establishment of inter-municipal cooperation and its member communes;

– members of the staff of the public establishment of inter-municipal cooperation and its member communes.

Lorsque l’arrêté ou le décret de dissolution d’un établissement public de coopération intercommunale prévoit, dans les conditions fixées au deuxième alinéa de l’article L. 5211-26, la nomination d’un liquidateur, celle-ci est prononcée par le représentant de l’Etat dans le département du siège de l’établissement.

Le représentant de l’Etat peut, à cette fin, désigner toute personne présentant des garanties de moralité suffisantes, disposant en matière juridique et financière de l’expérience et de la compétence jugées nécessaires à l’accomplissement de sa mission et n’ayant aucun intérêt à l’opération. Le liquidateur exerce sa mission à titre bénévole.

Ne peuvent être désignés comme liquidateur :

– les membres de l’organe délibérant ou du personnel de l’établissement public de coopération intercommunale et de ses communes membres ;

– les comptables et les personnes participant au contrôle budgétaire et de légalité de l’établissement public de coopération intercommunale et de ses communes membres ;

– les magistrats des juridictions administrative et financière dans le ressort desquelles l’établissement public de coopération intercommunale a son siège.
