Article R5213-78 of the French Labour Code

The State entrusts the Agence de services et de paiement with the payment and monitoring of the aids mentioned in article L. 5213-19 of the Code du travail under the following conditions:

a) The aid is granted, within the limits of the appropriations set out in the Finance Act, to adapted companies that have signed a multi-year contract of objectives and resources referred to in article L. 5213-13 ;

b) The aforementioned aid cannot be combined, for the same position, with any other aid of the same nature and for the same purpose, paid by the State;

c) Verification of the minimum and maximum proportions of workers recognised as disabled in the workforce of adapted companies or of detainees recognised as disabled workers among the detainees who have signed a prison employment contract working as part of the contract to set up an adapted company, as well as compliance with European rules relating to State aid, is carried out in particular on the basis of declarations made in electronic form via a teleservice.

Article R5213-78

L’Etat confie à l’Agence de services et de paiement le versement et les contrôles des aides mentionnées à l’ article L. 5213-19 du code du travail dans les conditions suivantes :

a) Les aides sont attribuées dans la limite des crédits inscrits dans la loi de finances, à des entreprises adaptées qui ont conclu un contrat pluriannuel d’objectifs et de moyens mentionné à l’article L. 5213-13 ;

b) Les aides susmentionnées ne peuvent se cumuler pour un même poste, avec une autre aide de même nature et ayant le même objet, versée par l’Etat ;

c) La vérification des proportions minimale et maximale de travailleurs reconnus handicapés dans les effectifs salariés des entreprises adaptées ou de personnes détenues reconnues travailleurs handicapés parmi les personnes détenues ayant signé un contrat d’emploi pénitentiaire travaillant dans le cadre du contrat d’implantation d’une entreprise adaptée, ainsi que le respect par des règles européennes relatives aux aides d’Etat, s’effectuent notamment à partir des déclarations réalisées sous forme dématérialisée par l’intermédiaire d’un téléservice.
