Article R5215-4 of the French General Code of Local Authorities

The operations decided upon, other than those mentioned in article R. 5215-5, which have received a start of execution constituted by the legal act creating between the contractor and the project manager a definitive contractual obligation, or in the case of work carried out directly, by the constitution of supplies or the start of execution of the work, are continued by the commune; those which have not received a start of execution come under the jurisdiction of the urban community.

By mutual agreement, the commune and the community may modify the rules set out above.

Les opérations décidées, autres que celles qui sont mentionnées à l’article R. 5215-5, qui ont reçu un commencement d’exécution constitué par l’acte juridique créant entre l’entrepreneur et le maître d’oeuvre une obligation contractuelle définitive, ou dans le cas de travaux effectués en régie directe, par la constitution d’approvisionnement ou le début d’exécution des travaux, sont poursuivies par la commune ; celles qui n’ont pas reçu un commencement d’exécution relèvent de la compétence de la communauté urbaine.

Par accord amiable, la commune et la communauté peuvent modifier les règles ci-dessus énoncées.
