I.-In order to work as an employee in France, the following persons must hold a work permit if they are employed in accordance with the provisions of this code:
1° Foreign nationals who are not nationals of a Member State of the European Union, another State party to the European Economic Area or the Swiss Confederation ;
2° A foreigner who is a national of a Member State of the European Union during the period of application of the transitional measures relating to the free movement of workers.
II – The application for a work permit is made by the employer.
However, if it concerns an employee temporarily seconded by a company not established in France, it is made by the principal established in France, in the cases provided for in 1° and 2° of article L. 1262-1, or by the user company in the case provided for in article L. 1262-2.
The request may also be made by a person authorised to do so by a written mandate from the employer or the company.
All new employment contracts are subject to an application for a work permit.
