Article R5221-43 of the French Labour Code

The provisions of articles R. 5221-41 and R. 5221-42 do not apply when the foreign national provides the employer with proof of registration on the jobseekers’ list issued by the institution referred to in article L. 5312-1 or when he/she is in the case provided for in 20° of article R. 5221-2.

Les dispositions des articles R. 5221-41 et R. 5221-42 ne s’appliquent pas lorsque l’étranger produit à l’employeur un justificatif d’inscription sur la liste des demandeurs d’emploi délivré par l’institution mentionnée à l’article L. 5312-1 ou lorsqu’il se trouve dans le cas prévu au 20° de l’article R. 5221-2.
