The request provided for in the first paragraph of Article 706-58 specifies the identity of the person and the reasons why, with regard to the elements contained in the file of the investigation proceedings or the information, which is attached, in copy or original, to the request, the statements of the person must be taken without his identity appearing in the proceedings.
The application may be accompanied by a record of the person’s hearing in which he or she expresses his or her agreement to testify anonymously, explaining any risks to himself or herself, his or her family or close relations if he or she were to testify without benefiting from the provisions of Article 706-58. A report from the investigators justifying the use of the procedure provided for in this article may also be attached.
When the request is made by the investigating judge, he or she sends it to the liberty and custody judge after taking the opinion of the public prosecutor, this opinion also being attached to the request.
