Article R53-3 of the French Code of Criminal Procedure

Applications for registration are addressed to the public prosecutor at the judicial court within whose jurisdiction the candidate resides. The public prosecutor examines the applications. He obtains the opinion of the examining magistrate, the guardianship judge and, where applicable, the children’s judge.

He forwards the file, for the opinion of the general assembly of the court, to the president of the judicial court.

The public prosecutor then forwards the file with the opinion of the court’s general assembly to the public prosecutor, who refers it to the first president of the court of appeal for consideration by the court’s general assembly.

The general assembly draws up the list of ad hoc administrators after hearing the magistrate responsible for the report and the public prosecutor.

Les demandes d’inscription sont adressées au procureur de la République près le tribunal judiciaire dans le ressort duquel le candidat a sa résidence. Le procureur instruit les demandes. Il recueille l’avis du juge d’instruction, du juge des tutelles et, le cas échéant, du juge des enfants.

Il transmet le dossier, pour avis de l’assemblée générale de la juridiction, au président du tribunal judiciaire.

Le procureur de la République transmet ensuite le dossier avec l’avis de l’assemblée générale du tribunal au procureur général qui en saisit le premier président de la cour d’appel aux fins d’examen par l’assemblée générale de la cour.

L’assemblée générale dresse la liste des administrateurs ad hoc après avoir entendu le magistrat chargé du rapport et le ministère public.
