Article R53-8-27 of the French Code of Criminal Procedure

The competent public prosecutor, pursuant to the provisions of Article 706-53-10, to order, at the request of the person concerned, the rectification or deletion of the information contained in the file or the limitation to six months or one year of the obligation to report is that of the last court that handed down a conviction that resulted in the person concerned being entered in the file. In the event that the last court is a court of appeal, the competent public prosecutor is that of the seat of the court of appeal.

If the registration results from the application of 6° of Article 706-53-2, the competent public prosecutor, within the meaning of the previous paragraph, is that of the judicial court of Nantes.

The request provided for by article 706-53-10 must, on pain of inadmissibility, be sent by registered letter with acknowledgement of receipt or made by declaration to the registry.

Le procureur de la République compétent, en application des dispositions de l’article 706-53-10, pour ordonner, à la demande de l’intéressé, la rectification ou l’effacement des informations figurant au fichier ou la limitation à six mois ou à un an de l’obligation de présentation est celui de la dernière juridiction qui a prononcé une condamnation ayant entraîné l’inscription de l’intéressé au fichier. Dans l’hypothèse où la dernière juridiction est une cour d’appel, le procureur de la République compétent est celui du siège de la cour d’appel.

Si l’inscription résulte de l’application du 6° de l’article 706-53-2, le procureur de la République compétent, au sens de l’alinéa précédent, est celui du tribunal judiciaire de Nantes.

La demande prévue par l’article 706-53-10 doit, à peine d’irrecevabilité, être adressée par lettre recommandée avec demande d’avis de réception ou effectuée par déclaration au greffe.
