Article R53-8-54 of the French Code of Criminal Procedure

Three months before the planned end of the detention period, the judge gives his opinion on the renewal of the measure to the public prosecutor at the court of appeal. The latter will refer the matter to the multi-disciplinary committee for security measures so that it can examine the situation of the detainee in the light of the information contained in his or her individual file. The provisions of the second paragraph of Article 706-53-14 relating to the prior placement of the person in a specialised service are not applicable.

The commission gives its opinion either on the renewal or release of the person under secure detention, or on the placement of the person under secure surveillance, with or without placement under mobile electronic surveillance. The matter is referred to the regional court for secure detention by the public prosecutor, which decides on these measures before the end of the one-year period.

Trois mois avant la fin prévue de la rétention, le juge fait connaître son avis sur le renouvellement de la mesure au procureur général près la cour d’appel. Ce dernier saisit la commission pluridisciplinaire des mesures de sûreté afin qu’elle examine la situation de la personne retenue, au vu des éléments figurant dans son dossier individuel. Les dispositions du deuxième alinéa de l’article 706-53-14 relatives au placement préalable de la personne dans un service spécialisé ne sont pas applicables.


La commission donne son avis, soit sur le renouvellement de la rétention de sûreté ou sur sa mainlevée, soit sur le placement de la personne sous surveillance de sûreté, avec ou sans placement sous surveillance électronique mobile. La juridiction régionale de la rétention de sûreté est saisie par le procureur général et se prononce sur ces mesures avant la fin de la période d’un an.
