Article R5312-24 of the French Labour Code

Pôle emploi is not subject to Chapter II of Title II of Book I of the regulatory part of the Code du Domaine de l’Etat and to the provisions of Decree No. 86-455 of 14 March 1986 relating to the abolition of property transaction and architecture commissions and the procedures for consulting the Estates Department.

Proposals to sell, contribute or create a security interest in a work or plot of land meeting the requirements of Article L. 5312-13 are communicated to the ministers responsible for employment and the budget, together with the draft agreement with the transferee, the transferee of the contribution or the beneficiary of the security interest. These ministers have a period of three months from receipt of the draft to make known their reasoned decision to oppose or, where applicable, the specific conditions to which they subject the completion of the transaction.

Pôle emploi n’est pas soumis au chapitre II du titre II du livre Ier de la partie réglementaire du code du domaine de l’Etat et aux dispositions du décret n° 86-455 du 14 mars 1986 relatif à la suppression des commissions des opérations immobilières et de l’architecture et modalités de consultation du service des domaines.

Les projets de cession, d’apport ou de création de sûreté portant sur un ouvrage ou terrain répondant aux caractéristiques de l’article L. 5312-13 sont communiqués aux ministres chargés de l’emploi et du budget, accompagnés du projet de convention avec le cessionnaire, le destinataire de l’apport ou le bénéficiaire de la sûreté. Ces ministres disposent d’un délai de trois mois à compter de la réception du projet pour faire connaître leur décision motivée d’opposition ou, le cas échéant, les conditions particulières auxquelles ils subordonnent la réalisation de l’opération.
