Article R532-29 of the French Monetary and Financial Code

The Autorité des marchés financiers and the authorities of the Member State of the European Union or party to the Agreement on the European Economic Area concerned shall be notified in advance of any change in the information notified pursuant to the provisions of the first paragraph of I of Article R. 532-28.

The Autorité des marchés financiers shall update the information contained in the certificate referred to in III of Article R. 532-28 and shall inform the competent authorities of the portfolio management company’s host Member State of any change in the scope of the authorisation granted to the said company or in the details of any restrictions on the types of UCITS that the company is authorised to manage.

Article R532-29

Toute modification relative aux éléments notifiés en application des dispositions du premier alinéa du I de l’article R. 532-28 est communiquée préalablement à l’Autorité des marchés financiers et aux autorités de l’Etat membre de l’Union européenne ou partie à l’accord sur l’Espace économique européen qui se trouve concerné.

L’Autorité des marchés financiers met à jour les informations contenues dans l’attestation mentionnée au III de l’article R. 532-28 et informe les autorités compétentes de l’Etat membre d’accueil de la société de gestion de portefeuille de tout changement dans le champ d’application de l’agrément accordé à ladite société ou dans les précisions relatives à toute restriction éventuelle sur les types d’OPCVM que cette société est habilitée à gérer.
