Article R533-21-1 of the French Monetary and Financial Code

For the application of Article L. 533-30-13, the conduct likely to result in the reduction or restitution, in whole or in part, of the variable remuneration shall be defined by the investment firms, taking into account, in particular, the serious losses that they may cause. The decision to reduce or refund the variable remuneration referred to in this article shall take into account the involvement of the person concerned in the conduct in question.

A decision to reduce or reimburse may also take into account the failure to comply with the requirements relating to good repute and competence applicable to the person concerned.

Pour l’application de l’article L. 533-30-13, les agissements susceptibles d’entraîner la réduction ou la restitution, en tout ou partie, de la rémunération variable sont définis par les entreprises d’investissement en considération notamment des pertes sérieuses qu’ils peuvent lui occasionner. La décision de réduction ou de restitution mentionnée à cet article tient compte de l’implication de la personne intéressée dans les agissements en cause.

Une décision de réduction ou de restitution peut également prendre en considération la méconnaissance des exigences d’honorabilité et de compétence qui sont applicables à la personne en cause.
