Article R561-37 of the French Monetary and Financial Code

I. – For the purposes of the first paragraph of I of Article L. 561-30-2, the TRACFIN department shall inform the person designated pursuant to I of Article R. 561-23 , in writing and by any means, of the transmission to the public prosecutor of the information memorandum referred to in Article L. 561-30-1, within fifteen days of such transmission.

II. – For the purposes of the second paragraph of I of Article L. 561-30-2, the department shall inform the President of the Bar Association of the Conseil d’Etat and the Cour de Cassation or the President of the Bar Association of the transmission of the report to the Public Prosecutor, under the same conditions as in I of this Article.

These authorities shall forward this information without delay to the person concerned.

Article R561-37

I. – Pour l’application du premier alinéa du I de l’article L. 561-30-2, le service TRACFIN informe, par écrit et par tout moyen, la personne désignée en application du I de l’article R. 561-23 de la transmission au procureur de la République de la note d’information mentionnée à l’article L. 561-30-1, dans un délai de quinze jours à compter de cette transmission.

II. – Pour l’application du deuxième alinéa du I de l’article L. 561-30-2, le service informe le président de l’ordre des avocats au Conseil d’Etat et à la Cour de cassation ou le bâtonnier de l’ordre des avocats de la transmission de la déclaration au procureur de la République, dans les mêmes conditions qu’au I du présent article.

Ces autorités transmettent cette information, sans délai, à la personne concernée.
