Article R561-39 of the French Monetary and Financial Code

For the application of 14° of I of Article L. 561-36, the administrative authority responsible for monitoring compliance by the persons mentioned in 9° of Article L. 561-2 with the obligations mentioned in the first paragraph of I of Article L. 561-36 is the Service Central des Courses et Jeux.

Inspections to monitor compliance by these persons with these obligations are carried out by national police officers responsible for the gaming police, specially authorised by order of the Minister of the Interior.

Inspections to ensure that the persons mentioned in 9° bis of Article L. 561-2 are complying with the obligations mentioned in the first paragraph of I of Article L. 561-36 are carried out by agents of the national gaming authority authorised pursuant to II of Article 42 of Law 2010-476 of 12 May 2010 on the opening up to competition and the regulation of the online gambling sector.

Pour l’application du 14° du I de l’article L. 561-36, l’autorité administrative compétente pour le contrôle du respect par les personnes mentionnées au 9° de l’article L. 561-2 des obligations mentionnées au premier alinéa du I de l’article L. 561-36 est le service central des courses et jeux.

Les inspections de contrôle du respect par ces personnes de ces obligations sont conduites par des agents de la police nationale chargés de la police des jeux, spécialement habilités par arrêté du ministre de l’intérieur.

Les inspections de contrôle du respect par les personnes mentionnées au 9° bis de l’article L. 561-2 des obligations mentionnées au premier alinéa du I de l’article L. 561-36 sont conduites par les agents de l’autorité nationale des jeux habilités en application du II de l’article 42 de la loi n° 2010-476 du 12 mai 2010 relative à l’ouverture à la concurrence et à la régulation du secteur des jeux d’argent et de hasard en ligne.
