Article R561-41 of the French Monetary and Financial Code

Inspections to ensure that the persons referred to in 10°, 11° bis and 14° of Article L. 561-2 are complying with the obligations referred to in the first paragraph of I of Article L. 561-36 are conducted by customs officers under the conditions defined in Title II of the Customs Code.

Findings made by customs officers on the basis of V of article L. 561-36-2 are recorded in a report sent to the National Enforcement Committee.

Les inspections de contrôle du respect par les personnes mentionnées aux 10°, 11° bis et 14° de l’article L. 561-2 des obligations mentionnées au premier alinéa du I de l’article L. 561-36 sont conduites par les agents des douanes dans les conditions définies au titre II du code des douanes.

Les constatations effectuées par les agents des douanes sur le fondement du V de l’article L. 561-36-2 sont relatées dans un procès-verbal transmis à la Commission nationale des sanctions.
