Article R561-8 of the French Monetary and Financial Code

The persons referred to in Article L. 561-2 are not required to identify the beneficial owner of the business relationship when their customer is a company whose securities are admitted to trading on a regulated market in France, in another Member State of the European Union, in another State party to the Agreement on the European Economic Area or which is subject to disclosure requirements in accordance with European Union law or which is subject to equivalent international standards guaranteeing adequate transparency of information relating to the ownership of the capital, which the person referred to in Article L. 561-2 is able to provide evidence of this to the supervisory authority referred to in Article L. 561-36.

Les personnes mentionnées à l’article L. 561-2 n’ont pas l’obligation d’identifier le bénéficiaire effectif de la relation d’affaires lorsque leur client est une société dont les titres sont admis à la négociation sur un marché réglementé en France, dans un autre Etat membre de l’Union européenne, dans un autre Etat partie à l’accord sur l’Espace économique européen ou qui est soumise à des obligations de publicité conformes au droit de l’Union ou qui est soumise à des normes internationales équivalentes garantissant une transparence adéquate des informations relatives à la propriété du capital, ce dont la personne mentionnée à l’article L. 561-2 est en mesure de justifier auprès de l’autorité de contrôle mentionnée à l’article L. 561-36.
