Article R563-2 of the French Monetary and Financial Code

I. – If, at the end of the period provided for in the second paragraph of Article R. 563-1, the operator has not complied with the formal notice given to it to cease the unlawful activity of online gaming or betting, a ban on fund transfers shall be imposed, on a proposal from the Autorité de Régulation des Jeux en Ligne, by order of the Minister responsible for the Budget.

This order designates the person or persons targeted by the prohibition decision and specifies whether the suspension of transfers applies to funds coming from, going to, or coming from and going to these accounts.

II. – The order specifies the duration of the ban provided for in I, which may not exceed six months. If, at the end of this period, the illegal operation of games continues, the prohibition decision may be renewed, after giving the operator the opportunity to present its observations, for one or more periods of up to six months.

Orders issued pursuant to this article are notified to the parties concerned and published in the Official Journal of the French Republic and, if they are issued against an operator whose registered office is located in another State of the European Union, in the Official Journal of the European Union.

Article R563-2

I. – Si, à l’issue du délai prévu au second alinéa de l’article R. 563-1, l’opérateur ne défère pas à la mise en demeure qui lui a été faite de cesser l’activité illicite de jeux ou paris en ligne, l’interdiction des transferts de fonds est prononcée, sur proposition de l’Autorité de régulation des jeux en ligne, par arrêté du ministre chargé du budget.

Cet arrêté désigne la ou les personnes visées par la décision d’interdiction et précise si la suspension des transferts porte sur les fonds en provenance, à destination, ou en provenance et à destination de ces comptes.

II. – L’arrêté précise la durée de l’interdiction prévue au I, qui ne peut excéder six mois. Si au terme de cette durée l’exploitation illicite de jeux se poursuit, la décision d’interdiction peut être renouvelée, après avoir mis l’opérateur à même de présenter ses observations, pour une ou plusieurs périodes d’une durée maximale de six mois.

Les arrêtés pris en application du présent article sont notifiés aux intéressés et publiés au Journal officiel de la République française ainsi que, s’ils sont opposés à un opérateur dont le siège est situé dans un autre Etat de l’Union européenne, au Journal officiel de l’Union européenne.
