The multidisciplinary commission for security measures is composed of:
1° A chamber president at the court of appeal appointed for a five-year term by the first president of the court of appeal within whose jurisdiction the commission sits, chairman;
2° The regional prefect, prefect of the defence zone within whose jurisdiction the commission sits, or his representative;
3° Of the inter-regional director of prison services with jurisdiction over the court of appeal where the commission sits, or his or her representative;
4° Of an expert psychiatrist;
5° Of an expert psychologist holding a diploma of specialised higher studies or a master’s degree in psychology;
6° Of a representative of a victim support association;
7° Of a lawyer, member of the bar council.
The persons mentioned in 4° to 7° are appointed jointly, for a period of five years, by the first president and the public prosecutor at the court of appeal in whose jurisdiction the commission sits. The lawyer is appointed on the proposal of the bar council of the judicial court of the town where this court sits.
If the importance of the cases to be handled by the committee so warrants, the first president of the court of appeal may appoint one or more vice-presidents of the committee, chosen from among the presidents of chambers or councillors of the court of appeal. He shall also appoint, jointly with the public prosecutor, alternate members for the persons mentioned in 4° to 7°.
The commission may rule when, in addition to its chairman, at least four of its members, whether full or alternate, are present.
The chairman of the commission has the casting vote.
The secretariat of the commission is provided by a registrar appointed by the chief registrar of the court of appeal.
The opinions of the commission are notified to the public prosecutor.
The provisions of Article R. 111-5 of the code de l’organisation judiciaire are applicable to the designations provided for in the second and tenth paragraphs of this article.
