Article R61-9 of the French Code of Criminal Procedure

The matter is referred to the commission by the sentence enforcement judge or by the public prosecutor. The sentenced person and his/her counsel and, where applicable, the public prosecutor are informed by the sentence enforcement judge of this referral.

The commission will issue a reasoned opinion within three months of the matter being referred to it. In the absence of an opinion within this timeframe, the judge may have the dangerousness assessment provided for in article 763-10 carried out. The offender is notified of this by registered letter or, if he or she is a prisoner, by the head of the prison. His lawyer and the public prosecutor are informed by the sentence enforcement judge.

La commission est saisie par le juge de l’application des peines ou par le procureur de la République. Le condamné et son conseil ainsi, le cas échéant, que le procureur de la République sont informés par le juge de l’application des peines de cette saisine.

La commission rend un avis motivé dans les trois mois de sa saisine. A défaut d’avis dans ce délai, le juge peut faire procéder à l’examen de dangerosité prévu à l’article 763-10. Cet avis est porté à la connaissance du condamné par lettre recommandée ou, s’il est détenu, par le chef de l’établissement pénitentiaire. Son avocat et le procureur de la République sont informés par le juge de l’application des peines.
