Article R611-17 of the French Intellectual Property Code

The designation of the inventor may be rectified only on request accompanied by the consent of the person wrongly designated, and, if the request is not made by the applicant or the proprietor of the patent, by the consent of either. The provisions of Article R. 612-10 are applicable.

If an erroneous designation of the inventor has been entered in the National Patent Register or published in the Bulletin officiel de la propriété industrielle, such entry or publication shall be rectified. The mention of the erroneous designation of the inventor shall be rectified in the copies of the publications of the patent application or of the fascicles of the patent not yet distributed.

The provisions of the preceding paragraph shall apply in the event of judicial annulment of the designation of the inventor.

La désignation de l’inventeur ne peut être rectifiée que sur requête accompagnée du consentement de la personne désignée à tort, et, si la requête n’est pas présentée par le demandeur ou le titulaire du brevet, du consentement de l’un ou de l’autre. Les dispositions de l’article R. 612-10 sont applicables.

Si une désignation erronée de l’inventeur a été inscrite au Registre national des brevets ou publiée au Bulletin officiel de la propriété industrielle, cette inscription ou publication est rectifiée. La mention de la désignation erronée de l’inventeur est rectifiée dans les exemplaires des publications de la demande de brevet ou des fascicules du brevet non encore diffusés.

Les dispositions de l’alinéa précédent sont applicables en cas d’annulation judiciaire de la désignation de l’inventeur.
