I. – The institutional medical committee in public health establishments or the institutional medical conference in private health establishments draws up :
1° An action programme, with monitoring indicators, for the proper use of medicines, in particular antibiotics and sterile medical devices. This programme contributes to the quality management of patient medication management and to the quality management of the sterile medical device circuit, in accordance with the procedures defined by order of the Minister for Health. It includes, where applicable, the actions required to implement the commitments relating to healthcare products set out in the contract to improve the quality and efficiency of care referred to in article L. 162-30-2 of the Social Security Code;
2° An assessment of the actions taken to improve the proper use of medicinal products and sterile medical devices;
3° The list of sterile medicinal products and medical devices whose use is recommended in the establishment;
4° Recommendations for prescribing sterile medical devices and medicines, particularly antibiotics.
II – The programme mentioned in 1° of I and the assessment of the actions mentioned in 2° of I are included in the programme of actions for the continuous improvement of the quality and safety of care mentioned in articles L. 6144-1 and L. 6161-2.
III. – In order to ensure the implementation of the programme mentioned in 1° of I and the recommendations mentioned in 4° of I, the legal representative of the health care establishment appoints, in consultation with the chairman of the establishment medical commission in public health care establishments or the establishment medical conference in private health care establishments, a referent for antibiotic therapy. This advisor assists the hospital medical committee or the hospital medical conference in proposing measures for the proper use of antibiotics and drawing up indicators to monitor the implementation of these measures; he/she organises therapeutic and diagnostic advice in the hospital. The same person may carry out this role in several healthcare establishments as part of a cooperation project.
