Article R6113-14 of the French Public Health Code

Visits are conducted in accordance with professional secrecy. The institution, all the institutions belonging to or associated with the regional hospital grouping or the organisation which is the subject of the grouping shall provide the experts responsible for these visits with any document required for their analysis. The medical experts may, at their request, consult medical records or documents under the conditions laid down in the last paragraph of article L. 1414-4. If these conditions are not met, the files or documents in question shall be rendered anonymous prior to consultation.

The competent authorities are informed of any facts or shortcomings affecting patient safety which are observed by the persons responsible for carrying out the certification visit.

Les visites sont conduites dans le respect du secret professionnel. L’établissement, l’ensemble des établissements parties ou associés au groupement hospitalier de territoire ou l’organisme qui en est l’objet communique aux experts chargés de ces visites tout document nécessaire à leur analyse. Les médecins experts peuvent consulter sur leur demande les dossiers ou documents médicaux dans les conditions prévues au dernier alinéa de l’article L. 1414-4. Lorsque ces conditions ne sont pas remplies, les dossiers ou documents considérés sont rendus anonymes préalablement à leur consultation.

Les faits ou manquements mettant en jeu la sécurité des patients, constatés par les personnes chargées d’effectuer la visite de certification, sont portés à la connaissance des autorités compétentes.
