Article R612-25 of the French Monetary and Financial Code

No person may carry out an inspection if he has been convicted of any of the offences referred to in II of Article L. 500-1 of this Code.

Before entrusting an assignment to one of the persons mentioned in I of Article R. 612-24, the Secretary General shall ensure that the prospective person is not likely to be in a conflict of interest with the person who is to be the subject of the audit assignment. To this end, the prospective person must inform the Secretary General of all professional relationships that he/she has had with the person who is to be the subject of the assignment over the previous three years. The Secretary General may not entrust an assignment to such a person if, during these three years, he or she has audited or advised the person concerned in areas related to the subject of the assignment.

Article R612-25

Nul ne peut effectuer un contrôle s’il a fait l’objet de l’une des condamnations mentionnées au II de l’article L. 500-1 du présent code.

Avant de confier un ordre de mission à l’une des personnes mentionnées au I de l’article R. 612-24, le secrétaire général s’assure que la personne pressentie n’est pas susceptible d’être en conflit d’intérêts avec la personne appelée à être l’objet de la mission de contrôle.A cette fin, la personne pressentie doit informer le secrétaire général de l’ensemble des relations professionnelles qu’elle a eues avec la personne appelée à être l’objet de la mission, au cours des trois années précédentes. Le secrétaire général ne peut lui confier une mission si, au cours de ces trois années, elle a contrôlé ou conseillé la personne concernée dans les domaines liés à l’objet de la mission.
