Article R612-36 of the French Monetary and Financial Code

The statement of objections informs the respondent that it may obtain a copy of the documents in the file from the Enforcement Committee secretariat and be assisted or represented by any counsel of its choice. The statement of objections states that any subsequent notification will be sent to the respondent at the address at which it received the statement of objections or, where applicable, at the last address it has notified to the Enforcement Committee secretariat by registered letter with acknowledgement of receipt.

The letter of notification of grievances is sent in the manner provided for in I of Article R. 612-9. It is simultaneously sent to the Chairman of the Enforcement Committee.

La notification des griefs informe la personne mise en cause qu’elle peut prendre connaissance et copie des pièces du dossier auprès du secrétariat de la commission des sanctions et se faire assister ou représenter par tout conseil de son choix. La notification des griefs mentionne que toute notification ultérieure serait adressée à la personne mise en cause à l’adresse à laquelle la notification de griefs lui est parvenue, ou, le cas échéant, à la dernière adresse qu’elle aura signalée au secrétariat de la commission par lettre recommandée avec demande d’avis de réception.

La lettre de notification des griefs est adressée selon les modalités prévues au I de l’article R. 612-9. Elle est transmise simultanément au président de la commission des sanctions.
