Article R612-55 of the French Intellectual Property Code

The request to convert the patent application referred to in Article R. 612-3 in an application for a utility certificate shall be made in writing at any time during the eighteen-month period from filing or from the priority date if priority has been claimed and, in any event, before the start of the technical preparations, provided for in Article R. 612-39, undertaken with a view to publication of the patent application.

La requête en transformation de la demande de brevet mentionnée à l’article R. 612-3 en demande de certificat d’utilité est formulée par écrit à tout moment pendant le délai de dix-huit mois à compter du dépôt ou de la date de priorité si une priorité a été revendiquée et, en tout état de cause, avant le début des préparatifs techniques, prévus à l’article R. 612-39, entrepris en vue de la publication de la demande de brevet.
