Article R613-1-2 of the French Monetary and Financial Code

The Autorité de contrôle prudentiel et de résolution may invite the competent authority of a Member State of the European Union or of another State party to the Agreement on the European Economic Area responsible for the supervision of a branch of significant importance to become a member of the college of supervisors of the entity supervised by the Autorité de contrôle prudentiel et de résolution. The Autorité de contrôle prudentiel et de résolution may also invite to participate in the college of supervisors the competent authority of the Member State of the European Union or of the State party to the Agreement on the European Economic Area where the parent undertaking of a financial holding company or a mixed financial holding company which has been granted approval in accordance with Article L. 511-17 is established.

L’Autorité de contrôle prudentiel et de résolution peut inviter l’autorité compétente d’un Etat membre de l’Union européenne ou d’un autre Etat partie à l’accord sur l’Espace économique européen en charge de la surveillance d’une succursale ayant une importance significative à devenir membre du collège des superviseurs de l’entité surveillée par l’Autorité de contrôle prudentiel et de résolution. L’Autorité de contrôle prudentiel et de résolution peut également inviter à participer au collège des superviseurs l’autorité compétente de l’Etat membre de l’Union européenne ou de l’Etat partie à l’accord sur l’Espace économique européen où est établie l’entreprise mère d’une compagnie financière holding ou d’une compagnie financière holding mixte qui s’est vue accorder une approbation conformément à l’article L. 511-17.
