Article R613-13 of the French Intellectual Property Code

In the cases provided for in Article L. 613-16, the matter is referred to the commission by reasoned decision of the Minister responsible for industrial property, taken at the request of the Minister responsible for public health.

This decision is notified, within forty-eight hours, with its reasons, to the owner of the patent and, where applicable, to the holders of licences on this patent entered in the National Patent Register, or to their representatives in France.

The operative part of the decision shall be published without delay in the Bulletin officiel de la propriété industrielle.

Article R613-13

Dans les cas prévus à l’article L. 613-16, la commission est saisie par décision motivée du ministre chargé de la propriété industrielle, prise sur requête du ministre chargé de la santé publique.

Cette décision est notifiée, dans les quarante-huit heures, avec ses motifs, au propriétaire du brevet et, le cas échéant, aux titulaires de licences sur ce brevet inscrites au Registre national des brevets, ou à leurs représentants en France.

Son dispositif est publié sans délai au Bulletin officiel de la propriété industrielle.
