Article R613-28 of the French Intellectual Property Code

The decree in the Council of State subjecting the patent, which is the subject of the formal notice, to the ex officio licence system, is issued on the joint report of the Minister responsible for industrial property, the Minister for the Economy and Finance, the Minister responsible for scientific research and atomic and space matters and, where appropriate, the Minister directly concerned in view of the subject matter of the patent.

It sets the conditions to be met by applicants for ex officio licences, taking into account any exploitation proposals made by the owner of the patent.

It is notified to the owner of the patent and to the licensees. It is entered ex officio in the National Patent Register and published in the Official Journal.

Le décret en Conseil d’Etat soumettant le brevet, objet de la mise en demeure, au régime de la licence d’office, est pris sur le rapport conjoint du ministre chargé de la propriété industrielle, du ministre de l’économie et des finances, du ministre chargé de la recherche scientifique et des questions atomiques et spatiales et, le cas échéant, du ministre directement intéressé compte tenu de l’objet du brevet.

Il fixe les conditions auxquelles devront satisfaire les demandeurs de licences d’office, en tenant compte des propositions d’exploitation éventuellement faites par le propriétaire du brevet.

Il est notifié au propriétaire du brevet et aux titulaires de licences. Il est inscrit d’office au Registre national des brevets et publié au Journal officiel.
