Article R613-34 of the French Intellectual Property Code

The request sent by the Minister of Defence to the Minister responsible for industrial property with a view to obtaining, pursuant to Article L. 613-19, an ex officio licence for national defence requirements, shall include all relevant details of the conditions necessary to meet those requirements and relating in particular:

<1° The total or partial nature of the licence with regard to the applications of the invention, which is the subject of the patent application or patent;

<2° The duration of the licence;

3° The respective rights and obligations of the State and the owner of the patent application or patent with regard to improvements or modifications made by either of them to the invention.

Article R613-34

La demande adressée par le ministre de la défense au ministre chargé de la propriété industrielle en vue d’obtenir, en application de l’article L. 613-19, une licence d’office pour les besoins de la défense nationale, comporte toutes précisions utiles sur les conditions nécessaires à la satisfaction de ces besoins et se rapportant en particulier :

1° Au caractère total ou partiel de la licence en ce qui concerne les applications de l’invention, objet de la demande de brevet ou du brevet ;

2° A la durée de la licence ;

3° Aux droits et obligations respectifs de l’Etat et du propriétaire de la demande de brevet ou du brevet en ce qui concerne les perfectionnements ou modifications apportés par l’un d’eux à l’invention.
