Article R613-37 of the French Intellectual Property Code

If the object of the ex officio licence is the exploitation of an invention covered by a patent application, the disclosure and free exploitation of which are prohibited by application of articles L. 612-9 or L. 612-10 (paragraphs 1 and 2), the court seised with a view to fixing the remuneration for the ex officio licence shall rule, both on the merits and before the court, by decisions which do not contain any analysis of the invention of such a nature as to lead to its disclosure.

These decisions are given in chambers. Only the public prosecutor, the parties or their representatives may obtain a copy.

Where the object of the ex officio licence is the working of an invention covered by a patent or by a patent application other than that referred to in paragraph 1 of this Article, if the applications of the said invention already made or envisaged are of a secret nature, the decisions of the court seised shall contain no mention of such a nature as to disclose the said applications and shall be subject to the provisions of paragraph 2 above.

If an expert opinion is ordered in the cases referred to in paragraphs 1 and 3 of this article, it may only be carried out by persons approved by the Minister of Defence and, if necessary, before his representatives.

Si la licence d’office a pour objet l’exploitation d’une invention couverte par une demande de brevet dont la divulgation et la libre exploitation sont interdites par application des articles L. 612-9 ou L. 612-10 (alinéas 1 et 2), la juridiction saisie en vue de la fixation de la rémunération de la licence d’office statue, tant au fond qu’avant-dire droit, par des décisions qui ne contiennent aucune analyse de l’invention de nature à en entraîner la divulgation.

Ces décisions sont rendues en chambre du conseil. Seuls le ministère public, les parties ou leurs mandataires peuvent en obtenir copie.

Au cas où la licence d’office a pour objet l’exploitation d’une invention couverte par un brevet ou par une demande de brevet autre que celle visée à l’alinéa 1 du présent article, si les applications de ladite invention déjà réalisées ou envisagées présentent un caractère secret, les décisions de la juridiction saisie ne contiennent aucune mention de nature à divulguer lesdites applications et sont soumises aux dispositions de l’alinéa 2 ci-dessus.

Si une expertise est ordonnée dans les cas visés aux alinéas 1 et 3 du présent article, elle ne peut être effectuée que par des personnes agréées par le ministre de la défense et, si besoin est, devant ses représentants.
