Article R613-54 of the French Monetary and Financial Code

For the application of X of Article L. 613-47, the provisional valuation provided for by this article includes the amount of losses that can reasonably be expected to be realised in the period between the date of the provisional valuation and the end of the resolution procedure.

In order to carry out this provisional valuation, the College of Resolution shall in particular take into account the following elements:

1° The balance sheet of the person concerned at the date of the provisional valuation ;

2° The average statistical default rate and the average statistical level of losses in the event of default for each of the portfolios of the person in resolution;

3° The share price of the person in question, where applicable, or the rate of return on its bond issues.

Pour l’application du X de l’article L. 613-47, la valorisation provisoire prévue par cet article inclut le montant des pertes dont il est raisonnable d’estimer qu’elles se réaliseront dans la période allant de la date de la valorisation provisoire jusqu’à l’issue de la procédure de résolution.

Pour procéder à cette valorisation provisoire, le collège de résolution prend notamment en compte les éléments suivants :

1° Le bilan de la personne concernée à la date de la valorisation provisoire ;

2° Le taux de défaut statistique moyen et le niveau statistique moyen des pertes en cas de défaut de chacun des portefeuilles de la personne en résolution ;

3° Le cours des actions de la personne en cause, le cas échéant, ou le taux de rendement de ses émissions obligataires.
