Article R614-5 of the French Intellectual Property Code

The conversion of the European patent application into a French patent application takes place as soon as the Institut national de la propriété industrielle receives the request. It is assigned a national registration number.

Subject to the provisions of articles L. 614-4 and L. 614-5, notice of the conversion shall be published in the Bulletin officiel de la propriété industrielle within one month of receipt of the request. The mention shall include the indications necessary for the identification of the patent application.

Within two months from the date of the publication referred to in the preceding paragraph or, in the case of patent applications which cannot be made public, from the date of receipt of the request for conversion, the applicant must provide proof of payment of the fees provided for in Article R. 614-17 and, where applicable, the French translation of the original text of the European patent application, as well as, where applicable, the text amended during the proceedings before the European Patent Office.

The procedure for granting the patent shall be conducted on the basis of the original text of the patent application or its translation or, where applicable, the text amended during the proceedings before the European Patent Office or its translation.

If the applicant does not have his domicile or registered office in a Member State of the European Community or in a State party to the Agreement on the European Economic Area, he must, within the same time limit, appoint a representative satisfying the conditions laid down in the first paragraph of Article R. 612-2 and communicate the name and address of the latter to the Institut national de la propriété industrielle.

Article R614-5

La transformation de la demande de brevet européen en demande de brevet français a lieu dès la réception par l’Institut national de la propriété industrielle de la requête. Un numéro d’enregistrement national lui est attribué.

Sous réserve des dispositions des articles L. 614-4 et L. 614-5, mention de la transformation est publiée au Bulletin officiel de la propriété industrielle dans le délai d’un mois à compter de la réception de la requête. La mention comporte les indications nécessaires à l’identification de la demande de brevet.

Dans le délai de deux mois à compter de la date de la publication visée à l’alinéa précédent ou, dans le cas de demandes de brevet qui ne peuvent être rendues publiques, à compter de la date de réception de la requête en transformation, le demandeur doit fournir la justification du paiement des redevances prévues à l’article R. 614-17 et, s’il y a lieu, la traduction en français du texte original de la demande de brevet européen, ainsi que, le cas échéant, du texte modifié au cours de la procédure devant l’Office européen des brevets.

La procédure de délivrance du brevet se déroule sur la base du texte original de la demande de brevet ou de sa traduction ou, le cas échéant, du texte modifié au cours de la procédure devant l’Office européen des brevets ou de sa traduction.

Si le demandeur n’a pas son domicile ou son siège dans un Etat membre de la Communauté européenne ou dans un Etat partie à l’accord sur l’Espace économique européen, il doit, dans le même délai, constituer un mandataire satisfaisant aux conditions prévues au premier alinéa de l’article R. 612-2 et communiquer le nom et l’adresse de celui-ci à l’Institut national de la propriété industrielle.
