Article R6146-21 of the French Public Health Code

Each healthcare professional who has concluded a contract as referred to in article R. 6146-17 sends the director of the establishment a monthly statement containing a list of the procedures performed on each patient.

On the basis of these documents and taking into account the information transmitted in application of the third paragraph of article L. 6113-7, the establishment determines the amount and pays the fees provided for in article L. 6146-2.

The fee provided for in the first paragraph of this same article, the amount of which is deducted from these fees, represents the share of the healthcare professionals’ costs borne by the establishment for the material and human resources it makes available to them. The rate of this fee is set according to the nature of the activity of the professional concerned. An order of the ministers responsible for the budget, social security and health lays down the method of calculation.

The establishment sends the monthly statements provided for in this article to each healthcare professional’s primary health insurance fund.

Article R6146-21

Chaque professionnel de santé ayant conclu un contrat mentionné à l’article R. 6146-17 transmet au directeur de l’établissement un état mensuel comportant la liste des actes dispensés à chaque patient.

Au vu de ces documents et compte tenu des informations transmises en application du troisième alinéa de l’article L. 6113-7, l’établissement procède à la détermination du montant et au versement des honoraires prévus à l’article L. 6146-2.

La redevance prévue au premier alinéa de ce même article, et dont le montant s’impute sur ces honoraires, représente la part des frais des professionnels de santé supportée par l’établissement pour les moyens matériels et humains qu’il met à leur disposition. Le taux de cette redevance est fixé en considération de la nature de l’activité du professionnel intéressé. Un arrêté des ministres chargés du budget, de la sécurité sociale et de la santé en fixe les modalités de calcul.

L’établissement communique les états mensuels prévus au présent article à la caisse primaire d’assurance maladie dont relève chaque professionnel de santé.
