In the interests of the service, the duties of head of department or head of internal structure or functional unit may be terminated by a joint decision of the director and the chairman of the establishment’s medical commission, after obtaining the opinion of the department head.
This decision may, where appropriate, be taken on the basis of a proposal from the department head. Upon receipt of a proposal to this effect, the Director and the Chairman of the Site Medical Commission have thirty days to take their decision. On expiry of this period, the proposal is deemed to have been rejected.
When the head of department or the person in charge of an internal structure or functional unit is an armed forces practitioner, the decision to terminate his duties is taken under the conditions set out in the first paragraph jointly by the Minister of Defence, the director and the chairman of the establishment’s medical committee. However, in the interests of the public hospital service or to meet the specific needs of defence, the Minister for Defence alone, or the Director and the Chairman of the Establishment Medical Commission jointly, may terminate the appointment directly. The agreement provided for in article L. 6147-9 shall be terminated or amended as soon as possible.
